How NRIs can buy property in Lucknow

Last updated 2 November 2026

An NRI or OCI can buy residential or commercial property in Lucknow, but not agricultural land, a farmhouse or plantation property. Payment must come through banking channels into India, or from NRE, FCNR(B) or NRO accounts. No RBI permission is needed for this kind of purchase, and much of the process can run remotely.

This guide draws on the Reserve Bank of India FAQ on immovable property, as updated in April 2023, which rests on the Non-Debt Instruments Rules 2019. It is general information. Confirm your case with your bank and a CA, and see the RBI page for the current text.

What property can an NRI buy in India?

An NRI or OCI may buy any immovable property in India other than agricultural land, a farmhouse or plantation property. That covers flats, villas, plots that are not agricultural, shops and offices.

Flat, house, villa, shop, office, non-agricultural plotYes, from a resident, NRI or OCIYes
Agricultural land, farmhouse, plantationNoYes, under the RBI’s conditions

A foreign-citizen spouse who is not an NRI or OCI may acquire one such property jointly with the NRI or OCI spouse, under conditions in the rules. Citizens of certain countries, including Pakistan, Bangladesh, Sri Lanka, Afghanistan, China, Iran, Nepal and Bhutan, generally need RBI permission unless they are OCI holders. Check the FAQ for the full list.

Check the land use, too. A plot on farmland outside the city may still be agricultural on the record, whatever the brochure calls it.

How must an NRI pay for property in India?

The money must reach India through normal banking channels, or come from an NRE, FCNR(B) or NRO account. Travellers’ cheques and foreign currency notes are not allowed.

  • Send money from your account abroad to your Indian account, or directly as your bank advises.
  • Use your own account, and pay the developer by bank transfer, never cash.
  • Keep every remittance advice and receipt. You will need them if you sell and send the money out.

The account you pay from affects what you can repatriate later. Money from NRE or FCNR(B) accounts or fresh remittances is treated differently from NRO money. Our repatriation guide explains this, so read it before you pay the first instalment.

Can an NRI get a home loan in India?

Yes. Indian banks and housing finance companies lend to NRIs, subject to RBI rules and their own terms. Under the RBI’s rules for rupee lending, the loan is repaid by remittance from abroad or from an NRE, FCNR(B) or NRO account.

Lenders differ on income proof, and on whether they will accept a project. If you are planning on a loan, speak to the bank before you book. Banks usually ask for a power of attorney holder in India to act for you during the loan.

Can an NRI buy without coming to India?

Yes, in most cases, with a power of attorney for the steps that need someone present. You can do much of the work over video and email, and sign the rest through your attorney.

  1. Share your budget, area and timing with Lalit on WhatsApp.
  2. Review a shortlist of RERA-registered projects, with a video walk-through of each site.
  3. Verify the project yourself on up-rera.in. See how to check a RERA number.
  4. Get a written cost sheet and read the draft agreement with your own lawyer.
  5. Make sure you have a PAN, and an NRE or NRO account for the payments.
  6. Book directly with the developer, and pay by bank transfer. See how the process works.
  7. Set up a power of attorney for signing and registry, if you will not be in India.

What taxes and costs does an NRI pay when buying?

An NRI pays the same stamp duty, registration and GST as a resident on the same purchase. Estimate these with the buying cost calculator.

TDS needs attention if the seller is also an NRI. The buyer must then deduct tax at the rates for non-residents, on the sale price, which is much more than the usual 1%. From 1 October 2026, reports say resident individual buyers can use their PAN for this, in place of a separate TAN. The rule may differ if you are the non-resident buyer, so ask your CA before you pay anything on a resale.

Which risks are greater for an NRI buyer?

The main extra risk is distance. You cannot see the site or check on a builder yourself, and a poorly chosen attorney or a tenant problem takes longer to fix.

  • Do not rely only on brochures or renders. Ask for a dated video of the actual site.
  • Check who holds your original documents and your login details.
  • Keep your own lawyer and your own CA, separate from anyone selling to you.
  • If you plan to let the flat, read what to check on rental income.
