How is buying resale different from buying from a developer?

With a new project the developer is the seller, the price list is fixed, and the project’s UP RERA registration covers much of the due diligence. With a resale, the seller is the current owner, the price is negotiated, and the checking falls on you — the property’s whole paper trail, not just the project’s registration. In exchange you get a finished home you can inspect as built, and you can move in or rent it out straight away.

What documents should you check before buying a resale property?

  • Title chain: the seller’s registered sale deed and the earlier deeds back to the original allotment, so ownership passes cleanly to you.
  • Encumbrance: confirm there is no outstanding mortgage or other charge. If the seller has a home loan on the flat, the bank’s loan-closure letter and release of the original documents must be part of the deal.
  • Approvals: the approved building plan and the completion or occupancy certificate for the building.
  • Society / maintenance: a no-dues certificate from the society or maintenance agency, and its transfer process.
  • Bills and taxes: paid-up property tax, electricity and water bills in the seller’s name.
  • The unit itself: the carpet area as measured, against what the papers say.

How does the resale process work step by step?

  1. Send your budget, preferred configuration and area on WhatsApp or by phone.
  2. A shortlist of ready-to-move units that match is shared, with video tours where available.
  3. Shortlisted units are visited in person, or coordinated remotely for NRI and out-of-city buyers.
  4. The documents above are collected from the seller and checked before any token amount.
  5. Price and payment terms are agreed and written into an agreement to sell.
  6. The sale deed is registered at the sub-registrar’s office with stamp duty paid, followed by transfer with the society and utilities.

Frequently asked questions

Is GST charged on a resale flat?

No. GST is not charged on the sale of a completed property after its completion or occupancy certificate has been issued, which covers resale flats. Stamp duty and registration charges still apply, at the rates set by the Uttar Pradesh government.

Can I take a home loan for a resale property?

Yes, banks lend on resale properties. The bank will run its own legal and technical check of the property's documents and value, so having the paperwork listed on this page ready speeds that up.

Who pays the agent on a resale purchase?

On a resale there is no developer paying a channel partner's commission, so the agent's fee is agreed between the parties. Agree it in writing before any site visit, so there are no surprises at registry.
